WELCOME TO INFOTUBE.NET. THE CONTENT OF THE InfoTube.net WEB SITE (the "Site")
AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED SUBJECT
TO THE FOLLOWING NOTICES, TERMS AND CONDITIONS (the "Terms").

Owner" throughout these Terms.

include: a. information provided by the Site Owner, such
as directories, home ownership and home sale transaction
tips and the provision of the forum for listing homes
for sale by owner ("Our Information" and "Our
Services"); b. information, links, responses to bids and directories
with respect to third party businesses
who sell products and services relating to home purchase
transactions and other household uses, ("Business
Information"); and c. information posted by homeowners
with respect to the sale of their home, including but
not limited to address, size, number of rooms, etc., photos,
virtual tours, comments and other information ("FSBO
Information").
Term and Termination.
You are bound by these Terms upon access to the Site.
Site Owner reserves the right to suspend or permanently
terminate the Site or Your access to the Site at any time,
for any reason and with or without prior notice to You.
Use of Site.
a. You agree to use
the Site in accordance with these Terms, as may be modified
from time to time, and such other terms, conditions and
procedures posted throughout the Site. Your use will at
all times comply with all applicable international, federal,
state, and local laws and regulations.
b. All content included
on the Site is the property of the Site Owner, its licensors,
affiliates, individual users, and advertisers, and protected
by U.S copyright, trademark and other laws. The content on the Site is for
Your personal use. Any other use, including the reproduction,
modification, distribution, transmission, republication,
or display, of the content contained on the Site is strictly
prohibited. The Site includes graphics, logos, and other
trademarks and service marks owned by the Site Owner or
its licensors, affiliates, individual users, or advertisers
and copying, altering, or otherwise removing from the
Site or distributing these items in any form to third
parties is strictly prohibited.
c. You agree not to
use the Site in any manner that damages or impairs the
Site or interferes with the use of the Site by others,
nor will You misappropriate or attempt to misappropriate
any portions of the Site, materials, software, programs,
code, or other information on or within the Site.
d. You agree not to
create links to any portion of the Site without the express
written permission of the Site Owner.
e. You acknowledge
and agree that the Site is not intended to be used to
complete contracts between sellers of homes or other products
or services and buyers of homes or other products or services.
Such transactions and contracts must be negotiated, performed
and completed outside of this Site. The Site is not intended
to create any offers or binding commitments between buyers
and sellers of homes, home products or services, but is
to be used merely as an information or research tool by
potential buyers and sellers.
f. Some areas of the Site require prior registration, which is free. If You choose not to register
You can still use the Site, but You will not be able to access areas that require registration. If You elect to register with
the Site, You certify that the e-mail address You provide is authentic and belongs to You. You further agree that You will maintain
only one registration with the Site. If your e-mail address changes, You agree to update your personal profile.
g. Submitting false Business Information or FSBO Information regarding a property or in requesting a bid is a violation of law and
can result in substantial personal legal risk. Site Owner reserves the right to monitor Business Information or FSBO Information to ensure a fair
process and to reject any Business Information or FSBO Information deemed to be made in bad faith, or that may be in violation of local laws or regulations.
Without limiting any other remedies, Site Owner may suspend or terminate Your use of the Site if You are found
(by conviction, settlement, insurance or escrow investigation or otherwise) to have engaged in fraudulent activity in connection
with your use of this Site.
Business Information and/or FSBO Information Contained on Site.
a. If You use the Site
to post Business Information or FSBO Information, You are wholly liable for and
assume all risks associated with the content of all submissions
to the Site and YOU AGREE TO INDEMNIFY AND HOLD THE SITE
OWNER, ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES,
AGENTS AND ASSIGNS HARMLESS FROM ANY LIABILITY THAT ARISES
FROM THE PUBLISHING OF THE BUSINESS INFORMATION OR FSBO INFORMATION THAT YOU SUBMIT.
If You list Business Information, You represent and warrant to Site Owner that you are legally licensed in regard to the Business Information.
If You list Business Information and/or FSBO Information, You warrant to Site Owner that
a) that the content of Your FSBO Information
will not contain any content that will damage the reputation
of the Site and/or the Site Owner, and that You will not
include in Your Business Information and/or FSBO Information any obscene material,
expletives, racially or ethnically objectionable material
or other otherwise objectionable material; and b) that the
content of Your Business Information or Business Information or FSBO Information will be accurate and
in compliance with all applicable international, federal,
state and local laws and regulations.
b. You acknowledge
and agree that the Site does not pre-screen content posted
by You. Therefore, You represent and warrant to the Site
Owner that any content posted by You on the Site is accurate,
truthful and that You have the legal right to upload such
information to the Site and submit such information to
the Site Owner.
c. By submitting Business Information or FSBO
Information pursuant to the procedures of the Site, You
grant to the Site Owner a non-exclusive, royalty-free,
perpetual, irrevocable and fully sublicensable license
to: use, reproduce, modify, distribute, transmit, combine
with third party information and other content, create
derivative works, and display such Business Information or FSBO Information or
other content submitted by You throughout the world in
any media.

BY USING THIS SITE, YOU ACKNOWLEDGE AND AGREE THAT THE
SITE OWNER IS NOT A REAL ESTATE OR MORTGAGE BROKER AND
THAT THE SITE DOES NOT ASSIST BUYERS AND SELLERS IN MAKING
CONTRACTS FOR THE SALE OF REAL PROPERTY AND DOES NOT PROVIDE
LENDING SERVICES FOR LOANS TO BE SECURED BY REAL PROPERTY.
No Liability/No Warranty/Indemnity.
a. The Site Owner assumes no responsibility for equipment failure in any electronic transmission.
Site Owner will make every effort to maintain system availability, except during scheduled maintenance periods.
Site Owner is not responsible for any bid requests that are not processed or accepted.
b. This Site provides Business Information and FSBO Information
and may provide other content provided by users. Such
content is not pre-screened or verified by the Site Owner.
The Site Owner cannot guarantee the accuracy, timeliness
or completeness of such Business Information or FSBO Information,
or other content posted on the Site relating to third
parties. The Site Owner is not responsible for and not
a party to any transaction that takes place between You
and any other party as a result of information available
through this Site. The Site Owner is not responsible for
any matters relating to a transaction between You and
any other party, including but not limited to, such third
party's representations whether through the Site or otherwise,
and the quality and timeliness of such other party's service, payment

invalid, the parties nevertheless agree that the court should endeavor to give
effect to the parties' intentions as reflected in the provision, and the other
provisions of these Terms and Conditions shall remain in full force and effect.
